Summary:
Eagle Scout and counselor-in-training had an accident with young teens in his car that caused injury to two of the occupants. Client had consumed beer, had too many occupants in his car, and failed to control his speed under icy conditions. He was jailed and was to be dismissed from his high school to be placed in an alternative school due to the felony accusations. Two years later, drug addiction took hold of our client resulting in the violation of a probated sentence for possession of a controlled substance.
Result:
The client's grand jury hearing for the accident resulted in three "No-Bills"; we argued that the blood alcohol level was one half of the maximum legal limit, that icy conditions resulted in an accident with no harm intended, and that the client's past showed no history of his being a serial offender. The accident was deemed a civil matter and removed from criminal proceedings.
The client's high school principal and school district overturned their initial decision and kept him in his high school due to our firm's appeal and effective explanation of the legality of their position. Two years later, while our client was in the middle of his probation violation for possession, our firm convinced the client's probation officers to keep him out of jail and allow him to attend a drug rehabilitation facility outside of their jurisdiction. The client had his probation reinstated and transferred to the jurisdiction where his rehab was taking place and where he currently resides. Highlights:
The client experienced a recovery in the facility our firm recommended. He became active in Narcotics Anonymous, became employed, and eventually was able to support himself in his own apartment and attend college. His family realized the miracle of their son's redemption from a totally destructive life style.
